Terms of Service

FOSSA is an online marketplace that lets users in Madagascar discover, list, and post about vehicles, property, businesses, and goods and services (“Listings”). FOSSA provides the platform only — we are not a party to, and do not guarantee, any transaction, sale, rental, or agreement between users.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

You are solely responsible for the accuracy, legality, and content of anything you post, including business profiles and Listings (“User Content”). By posting User Content, you represent that you have the right to do so and grant FOSSA a non-exclusive, worldwide, royalty-free license to host, display, and distribute it as part of operating the Service.

You may not post content that is fraudulent, misleading, illegal, infringing, or that advertises prohibited goods or services. We may remove or refuse any User Content, and suspend or terminate accounts, at our discretion.

Where FOSSA marks a business or listing as “verified,” that reflects FOSSA’s own review process at a point in time — it is not a warranty or guarantee of the business’s current legitimacy, solvency, or the quality of goods or services offered, and you should exercise your own judgment before transacting.

FOSSA does not own, sell, inspect, or take possession of any item, property, or service listed on the platform, and is not responsible for the conduct of any user, buyer, or seller. Any dispute arising from a transaction is between the parties to that transaction; FOSSA is not liable for the outcome.

You agree not to: violate any applicable law; infringe another’s intellectual property or privacy rights; upload malware or attempt to disrupt or gain unauthorized access to the Service; scrape or harvest data from the Service without permission; or impersonate any person or entity.

The FOSSA name, logo, and platform (excluding User Content) are owned by FOSSA SARL and protected by intellectual property law. You may not use our branding without prior written permission.

The Service may link to, or let you sign in through, third-party websites or services (such as Google or Apple) that we do not control. We are not responsible for the content, policies, or practices of any third party.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOSSA SARL AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY TRANSACTION WITH ANOTHER USER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold FOSSA harmless from any claim, loss, or demand, including reasonable legal fees, arising from your use of the Service, your User Content, or your violation of these Terms.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms, without prior notice where warranted.

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above; continued use of the Service after a change constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Madagascar, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Antananarivo, Madagascar, except where mandatory local consumer-protection law provides otherwise.
