How to file a takedown notice

Send the agent a written notice that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim was infringed.
  3. The URL(s) on FOSSA of the material you claim is infringing, specific enough for us to find it.
  4. Your name, address, telephone number and email address.
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.

Knowingly misrepresenting that material is infringing may make you liable for damages (17 U.S.C. § 512(f)).

What we do

When we receive a complete notice we remove or disable access to the identified material promptly and notify the user who posted it. We may share the notice, including your contact details, with that user.

Counter-notice

If your material was removed by mistake or misidentification, send the agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the removed material and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification.
  4. Your name, address and phone number, and consent to the jurisdiction of the federal court for your address (or, if outside the US, any judicial district where FOSSA can be found), and that you will accept service of process from the complainant.

We forward the counter-notice to the complainant. Unless they tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after receiving the counter-notice.

Repeat infringers

We terminate the accounts of users who are repeat infringers in appropriate circumstances.
